I was just wondering if anybody knows the legalities of using Barbie as a model when selling fashion doll clothes. I want to do some post cards and other material. As long as I mention that I am in no way affiliated or associated with Mattel am I safe? I know Mattel defends their copyright, and rightfully so but I do use Barbie as my model. I know a lot of people who do OOAK's used to advertise in Barbie Bazaar but I also seem to remember some getting in trouble for copyright infringement. I just looked through the magazine and don't see ads from anybody that is not a Mattel dealer with an ad using Barbie. I would love to converse about this and learn more.

I would NOT use a Barbie doll as a model for your advertising. At the very least, I would figure out a way to make an unidentifiable head with no features. You should also figure on a way to alter the body to become your design. This means if you have to, change the shape of the bosom so the breasts aren't the obvious torpedo boobs. In no way would I use a Barbie as a model even with all the disclaimers. Mattel does NOT like its Barbie dolls associated in any way with any one or any other purpose other than what they deem acceptable. And they are a tentacle monster you don't want to slightly provoke.
