If they can be reached by such "accept" messages, it seems to me they can be identified. More and more jurisdictions of the world are passing strong anti-spam legislation (Virginia, USA, just extradited a couple of spammers, and are preparing to throw the book at them). Thus the presence of such identification seems worth more than you are losing by having the occasional annoyance.
I don't have time to sue spammers, and I suppose there are not many people who have, so in my opinion it's better to get the list spam-free again.
